Poland Probes into ChatGPT and OpenAI after GDPR Complaint
The agency is doing the investigation after a complaint that an anonymous party filed, accusing the platform of unreliably and unlawfully processing data.

The Personal Data Protection Office (UODO) of Poland has started an examination of ChatGPT (the AI project launched by OpenAI). The agency is doing the respective investigation after a complaint that an anonymous party filed, accusing the platform of unreliably and unlawfully processing data.
Poland Starts Investigation into ChatGPT and OpenAI Following a Complaint
Jan Nowak, the data protection office’s president, commented on this on 20 September. He stated that such doubts had severally been raised concerning ChatGPT’s compliance in Europe. As per Nowak, these concerns were mostly related to privacy, data protection, and so on. The complaint says that OpenAI supposedly processed the data in an unreliable and illegal manner.
In addition to this, it noted that the data collection and processing-related rules of the platform are non-transparent. Moreover, the applicant mentioned that ChatGPT allegedly generated fake information regarding him. The applicant added that OpenAI did not let him exercise rights in line with the European General Data Protection Regulation.

Nonetheless, Nowak admitted that the proceedings confronting the platform might become challenging. He added that the proceedings concern a firm external to the European Union. According to Nowak, the case deals with several provisions related to personal data protection. Hence, he disclosed, that this indicates why OpenAI is answerable to many questions.

In the meantime, UODO’s deputy president Jakub Groszkowski brought to the front that the complaint’s accusations raise apprehensions. They deal with OpenAI’s method related to the principles of Europe on the protection of personal data.

Thus, UODO will clarify the respective doubts, specifically against the context of the primary rule of privacy. OpenAI has even previously raised doubts about its compliance with the European GDPR. In March this year, Italian officials provisionally blocked ChatGPT of OpenAI and started a probe into alleged data privacy breaches.
